No. 1. Introduction and Acceptance of Terms

1.1. Welcome to Omnia! These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you") and Individual Entrepreneur EasyAI ("EasyAI," "we," "us," "our"), registered in the Republic of Kazakhstan, regarding your use of the "Omnia" mobile application ("Application") and all related services, features, and content provided through the Application ("Service").

1.2. PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APPLICATION. BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APPLICATION OR ANY PART THEREOF, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND UNCONDITIONALLY ACCEPT THESE TERMS AND AGREE TO BE BOUND BY THEM. If you do not agree with any provision of these Terms, you must not install, access, or use the Application.

1.3. Acceptance of these Terms also signifies your acknowledgment and agreement with our Omnia Privacy Policy (https://easyai.org.kz), which is an integral part of these Terms and describes how we collect, use, and protect your personal data.

1.4. We reserve the right, at our sole discretion, to modify or supplement these Terms at any time. We will notify you of material changes by posting an updated version of the Terms in the Application and on our official website https://easyai.org.kz, indicating the date of the last update. Your continued use of the Application after such changes are made will constitute your acceptance of the updated Terms. We encourage you to periodically review these Terms for changes.

No. 2. Description of the Service

2.1. The Omnia Application provides personalized astrological insights, daily forecasts, and analysis of various life spheres ("Daily Indicators" or "Spheres of Influence of the Day") based on your selected zodiac sign, your device's time zone, and your preferred language.

2.2. The Service is provided solely for informational and entertainment purposes. The information provided through the Application is not and should not be considered as financial, legal, medical, psychological, or any other professional advice or consultation.

No. 3. User Account

3.1. To use the Application, traditional registration with the creation of a login and password is not required. Upon the first launch of the Application on your device, a unique anonymous user identifier (Persistent User UUID) is generated, which is used to personalize your experience with the Application, save your settings, and manage your subscriptions on our servers.

3.2. This Persistent User UUID is stored locally on your device in the secure Keychain storage. You are responsible for ensuring the security of your mobile device and preventing unauthorized access to it, as access to the Application and its associated data is through your device.

3.3. We are not liable for any loss or damage arising from unauthorized access to your device and, consequently, to your profile in the Application.

No. 4. License to Use the Application

4.1. In accordance with these Terms, EasyAI grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on a mobile device that you own or control, solely for your personal, non-commercial use.

4.2. All rights not expressly granted to you in these Terms are reserved by EasyAI.

No. 5. Intellectual Property

5.1. The Application, including, but not limited to, its design, text, graphics, images, videos, information, software, music, sound, and other files, as well as their selection and arrangement ("Application Content"), and all related trademarks, service marks, logos (including the name "Omnia" and the logo) are the exclusive property of EasyAI and/or its licensors and are protected by copyright, trademark, and other intellectual property laws of the Republic of Kazakhstan and international treaties.

5.2. Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, transfer, publicly display, publicly perform, publish, adapt, edit, or create derivative works based on the Application Content or any part thereof without the prior written permission of EasyAI.

No. 6. Rules for Using the Application (User Obligations)

6.1. By using the Application, you agree to:

6.1.1. Comply with all applicable laws, rules, and regulations.

6.1.2. Use the Application exclusively for personal, non-commercial purposes and in accordance with these Terms.

6.1.3. Not use the Application in any manner that could damage, disable, overburden, or impair the Application or our servers, or interfere with any other party's use of the Application.

6.1.4. Not attempt to gain unauthorized access to the Application, other users' accounts (if any are ever implemented), computer systems, or networks connected to our servers through hacking, password mining, or any other means.

6.1.5. Not decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Application or any part thereof.

6.1.6. Not circumvent, disable, or otherwise interfere with security-related features of the Application or features that prevent or restrict the use or copying of any Application Content.

6.1.7. Not use automated means (such as bots, parsers, scrapers) to access, collect data from, or otherwise interact with the Application without our prior written consent.

6.2. Any use of the Application or Application Content other than as specifically authorized herein is strictly prohibited and may result in the termination of your license to use the Application.

No. 7. Paid Services and Subscriptions

7.1. Availability: The Omnia Application offers both free access to basic functionality and paid subscriptions ("Subscriptions") that provide access to enhanced features and content. A detailed description of the current subscription tiers and their benefits is available in the Application and on the Application's page in the Apple App Store. The following subscription tiers are currently available:

7.1.1. Free version (Free): Provides access to daily astrological insights (description of the day) and a limited set (the first 8) of "Daily Indicators" with their numerical value and detailed description.

7.1.2. Standard Subscription: Includes all features of the free version, as well as full access to all 40 "Daily Indicators" daily with their numerical values and detailed descriptions. Data is updated daily at 00:00 local user time.

7.1.3. Premium Subscription: Includes all features of the Standard Subscription, and also provides access to data for the previous day ("yesterday") and for 14 days ahead via the "Forecast Calendar," where all 40 "Daily Indicators" with their numerical values and descriptions are available for each date.

7.2. Payment: All Subscriptions are purchased through the Apple App Store in-app purchase system. Payment will be charged to your Apple ID account at the time of purchase confirmation. You agree to pay all applicable fees for your chosen Subscription.

7.3. Automatic Renewal: Subscriptions are automatically renewable unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period at the cost of your chosen subscription.

7.4. Managing Subscriptions and Canceling Auto-Renewal: You can manage your subscriptions and turn off auto-renewal in your Apple ID account settings after purchase. Go to your device's Settings -> [your name] -> Subscriptions.

7.5. Refund Policy: In accordance with Apple App Store policy, all refund requests for purchased Subscriptions must be directed to Apple support. We are unable to process refunds ourselves for purchases made through the Apple App Store.

7.6. Price Changes: We reserve the right to change the price of Subscriptions. Any price changes will take effect only after the end of your current subscription period and with prior notice to you through the Apple App Store or by other means, allowing you to cancel the subscription before the changes take effect.

No. 8. Disclaimer of Warranties and Limitation of Liability

8.1. Informational and Entertainment Nature: YOU UNDERSTAND AND AGREE THAT THE APPLICATION AND ALL INFORMATION, CONTENT, MATERIALS, AND SERVICES INCLUDED IN IT OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE APPLICATION (INCLUDING, BUT NOT LIMITED TO, ASTROLOGICAL FORECASTS, DAILY INSIGHTS, AND "DAILY INDICATORS") ARE PROVIDED SOLELY FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES. THIS INFORMATION IS NOT AND SHOULD NOT BE CONSIDERED AS FINANCIAL, LEGAL, MEDICAL, PSYCHOLOGICAL, OR ANY OTHER PROFESSIONAL ADVICE OR CONSULTATION. FORECASTS AND INTERPRETATIONS ARE SUBJECTIVE AND DO NOT GUARANTEE ANY SPECIFIC RESULTS OR OUTCOMES.

8.2. No Warranties: THE APPLICATION AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND. EASYAI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APPLICATION WILL OPERATE UNINTERRUPTED, SECURELY, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APPLICATION OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8.3. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASYAI, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE APPLICATION, OR INABILITY TO ACCESS OR USE IT, EVEN IF EASYAI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE CLAIMS ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

8.4. You use the information obtained through the Application at your own risk. EasyAI is not responsible for any decisions, actions, or omissions made by you based on the information or materials presented in the Application.

No. 9. Modification and Termination of Terms/Service

9.1. Modification of Terms: We reserve the right to modify these Terms as stated in section 1.4.

9.2. Modification of the Service: We are constantly working to improve the Application and may add, change, or remove features and functionalities of the Application at our discretion. We may also suspend or completely discontinue the provision of the Service. We will endeavor to notify you of material changes or termination of the Service if it is appropriate and feasible.

9.3. Termination of Your Access: We may suspend or terminate your access to the Application and Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms. In the event of termination, your right to use the Application will cease immediately.

9.4. Provisions of these Terms that by their nature should survive termination (including, but not limited to, provisions on intellectual property, disclaimer of warranties, limitation of liability, and dispute resolution) shall survive.

No. 10. Link to Privacy Policy

Your privacy is important to us. Please review our Omnia Privacy Policy (https://easyai.org.kz), which describes how we collect, use, disclose, and protect your personal data. The Privacy Policy is an integral part of these Terms.

No. 11. Applicable Law and Dispute Resolution

11.1. These Terms and any disputes or claims arising out of or in connection with them, their subject matter, or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions.

11.2. The parties shall make every effort to resolve any disputes arising from or in connection with these Terms through negotiation.

11.3. If a dispute cannot be resolved through negotiation within a reasonable period (e.g., 30 days), it shall be subject to resolution in the competent courts at the location of Individual Entrepreneur EasyAI (Republic of Kazakhstan), unless otherwise provided by mandatory provisions of applicable law.

No. 12. Age Restrictions

12.1. The Omnia Application is intended for use by individuals who are at least 18 years of age. If you are under 18 years of age, you must not download, install, access, or use the Application.

12.2. We do not knowingly collect personal data from individuals under the age of 18. If we become aware that we have received personal data from an individual under 18 years of age without parental or legal guardian consent, we will take steps to delete such information. If you are a parent or guardian and believe that your child has provided us with personal data, please contact us.

No. 14. Final Provisions

14.1. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and EasyAI regarding the use of the Application and supersede all prior or contemporaneous understandings and agreements, whether written or oral, on this subject matter.

14.2. No Waiver: The failure of EasyAI to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.3. Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to best achieve the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of these Terms shall remain in full force and effect.

14.4. Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.
